New: Effective July 1, 2024 HB 874 - State Board of Long–Term Care Administrators – Requirements for Assisted Living Managers

​Bill Synopsis: Extending, from October 1, 2024 to July 1, 2026, the date by which an individual must be licensed by the State Board of Long-Term Care Administrators before practicing as an assisted living manager in the State; altering the requirements for the manager training course that certain assisted living managers are required to complete; altering the requirements for serving as an interim assisted living manager; and requiring the Board to submit certain reports on assisted living managers to certain committees of the General Assembly.

WHAT’S HAPPENING IN LONG-TERM CARE


New: Centers for Medicare and Medicaid Services (CMS) News: Final Rule - Medicare and Medicaid Programs; Minimum Staffing Standards for Long-Term Care Facilities and Medicaid Institutional Payment Transparency Reporting

This final rule, effective June 21, 2024, establishes minimum staffing standards for long-term care facilities, as part of the Biden-Harris Administration's nursing home reform initiative to ensure safe and quality care in long-term care facilities. In addition, this rule requires States to report the percent of Medicaid payments for certain Medicaid-covered institutional services that are spent on compensation for direct care workers and support staff.

Provisional Licenses for
​Non-licensed Persons

House Bill 145, Board of Examiners of Nursing Home Administrators—Non-licensed Persons–Provisional Licensure, was passed by the House on February 24, 2017 and was passed by the Senate on March 29, 2017. It was signed into law by Governor Hogan on April 11, 2017 . The law became effective October 1, 2017. HB 454 Health Occupations - Licenses, Certificates, and Registrations - Lawful Presence and Identification Numbers: 

In accordance with HB 454, as of October 1, 2023, a health occupations board is prohibited from requiring as a condition for licensure, certification, or registration that an applicant (1) provide proof of lawful presence in the United States, or (2) have a Social Security number or individual taxpayer identification number.

Applicants who do not hold an SSN or ITIN and are applying with alternative documentation as permitted by the Department of Health and Human Services under section 466(A)(13) of the Social Security Act, (the “Act”) must submit the appropriate documentation as permitted by the Act. The applicant should contact the Board at mdh.bltca@maryland.gov for additional information.

Criminal History Records Checks - Required​​​

Per § 9-302.1 of the Annotated Code of Maryland, you must undergo a criminal history records check in order to be granted a Long-Term Care​​ Administrator License by the Board, and this is inclusive of Provisional ​Licenses.  Current licensees who have not yet had a criminal history records check done, must undergo this required screening one time as a part of their renewal process. 

If an applicant is currently licensed by another State of Maryland Health Occupations board and has previously undergone a criminal history records check with that board, he/she is responsible for providing this Board with a verifiable copy of this criminal history records check.  Until the Board Office receives notification of your criminal history records check, you will not be able to receive your license.  

Important Note: Administrator-in-Training and Endorsement applicants, please have your criminal history records check completed by the application deadline that corresponds to your intended Credentials Committee Meeting date.
