​Effective July 1, 2024 HB 874 - State Board of Long–Term Care Administrators – Requirements for Assisted Living Managers

Bill Synopsis: Extending, from October 1, 2024 to July 1, 2026, the date by which an individual must be licensed by the State Board of Long-Term Care Administrators before practicing as an assisted living manager in the State; altering the requirements for the manager training course that certain assisted living managers are required to complete; altering the requirements for serving as an interim assisted living manager; and requiring the Board to submit certain reports on assisted living managers to certain committees of the General Assembly.

Effective June 21, 2024:  Final Rule - Medicare and Medicaid Programs; Minimum Staffing Standards for Long-Term Care Facilities and Medicaid Institutional Payment Transparency Reporting

This final rule establishes minimum staffing standards for long-term care facilities, as part of the Biden-Harris Administration's nursing home reform initiative to ensure safe and quality care in long-term care facilities. In addition, this rule requires States to report the percent of Medicaid payments for certain Medicaid-covered institutional services that are spent on compensation for direct care workers and support staff.

Effective October 1, 2023: HB 454  Health Occupations - Licenses, Certificates, and Registrations - Lawful Presence and Identification Numbers: 

In accordance with HB 454, a health occupations board is prohibited from requiring as a condition for licensure, certification, or registration that an applicant (1) provide proof of lawful presence in the United States, or (2) have a Social Security number or individual taxpayer identification number. Applicants who do not hold an SSN or ITIN and are applying with alternative documentation as permitted by the Department of Health and Human Services under section 466(A)(13) of the Social Security Act, (the “Act”) must submit the appropriate documentation as permitted by the Act. Effective October 1, 2019:  HB 592  Health Care Facilities - Comprehensive and Extended Care Facilities- Discharges and Transfers

Altering the basic rights afforded to each resident of a comprehensive care facility and an extended care facility; requiring certain individuals to pursue certain assistance from the medical assistance program in a certain manner; requiring a facility to provide a certain written notice as soon as practicable before discharge or transfer under certain circumstances; requiring a facility, under certain provisions of law, to provide at least a 3-day supply of medications needed by the resident at the time of discharge or transfer; etc.

Effective October 1, 2017: HB 145 Board of Examiners of Nursing Home Administrators—Provisional Licenses for Non-licensed Persons

In accordance with House Bill 145,  requiring the owner of a nursing home or other appropriate nursing 4 home authority, under certain circumstances, to immediately appoint a non-licensed person to serve in the capacity of interim, instead of acting, nursing home administrator; authorizing the appointed non-licensed person to act as the interim 7 nursing home administrator on filing an application with the State Board of 8 Examiners of Nursing Home Administrators requesting a certain provisional license.
