MDH Emergency Regulations Process
For urgent regulatory proposals, MDH units have the option of promulating the regulations as an emergency action. Emergency actions, which are utilized in exigent circumstances, bypass the normal public and comment period associated with an ordinary regulatory proposal. Emergency proposals are generally submitted simulatenously with an identical proposal that will go through the standard promulgation process, including public comment. This ensures that there is no lapse between effective dates of the emergency and proposed actions.
Emergency actions must be approved by the Joint Committee on Administrative, Executive, and Legislative Review (AELR) and can be granted emergency status for up to 180 days. AELR may grant extensions for emergency status. Requests for emergency status should be submitted to AELR at least 10 business days, but ideally 1 month, prior to the requested effective date.
