Notice of Proposed Action

The Secretary of Health and Mental Hygiene proposes to amend:
(1) Regulations .02, .04, and .05 under COMAR 10.63.01 Requirements for All Licensed Programs;
(2) Regulations .14, .18, and .19 under COMAR 10.63.03 Descriptions and Criteria for Programs and Services Required to Have an Accreditation-Based License;
(3) Regulation .03 under COMAR 10.63.04 Additional Requirements for Accreditation-Based Licenses for Specific Residential Community-Based Behavioral Health Services; and
(4) Regulation .10 under COMAR 10.63.06 Application and Licensure Process.
Statement of Purpose
The purpose of this action is to update the behavioral health program licensure requirements and to add the program exemption requirements.

There is no corresponding federal standard to this proposed action.

10.63.01 Requirements for All Licensed Programs

.04 Exempt Providers.
A. In accordance with Health-General Article, [§§8-403 and 10-901] §7.5-401, Annotated Code of Maryland, the following providers are exempt from the requirements of, and are not required to be licensed under, this subtitle:

B. Notwithstanding the provisions of §A of this regulation, a provider shall have a valid and current license under this subtitle in order to provide the following services:

C. The Department may exempt a program from the requirements of this subtitle:
(1) If the program:
(a) Is a pilot project;

(c) Does not fall within any of the program descriptions set out in:
(i) COMAR 10.63.03;
(ii) COMAR 10.63.04; or
(iii) COMAR 10.63.05; and
(2) If the program demonstrates to the satisfaction of the Department that it is subject to:
(a) Contractual provisions;
(b) Conditions of grant award; or
(c) Other requirements that are comparable to the regulations in this subtitle.

10.63.03 Descriptions and Criteria for Programs and Services Required to Have an Accreditation-Based License

(3) Is available to provide on-site monitoring of care and further evaluation on a daily basis.

10.63.04 Additional Requirements for Accreditation-Based Licenses for Specific Residential Community-Based Behavioral Health Services
