Waiver for Adults with Brain Injury

​The Brain Injury (BI) Waiver is a home and community-based services waiver. It helps you get services and support in your home and community instead of in an institution.

The Maryland Department of Health Behavioral Health Administration​ runs this waiver program for Medicaid. This is known as the Operating State Agency (OSA). The OSA focuses on serving the people in the ​waiver and manages specific waiver services.

Am I eligible for the BI Waiver?

You must meet all the medical, technical and financial rules to be eligible for this waiver.

  • Medical Eligibility Rules:
    • Have a brain injury diagnosis for an injury that happened after the age of 17.
    • Need nursing facility or chronic hospital level of care.
  • ​Technical Eligibility Rules:
    • Be 22 to 64 years old.
    • Must be an inpatient in one of the following:
      • State psychiatric hospital
      • State or private nursing facility  
      • Maryland-licensed special hospital for chronic disease - CARF-accredited for brain injury inpatient rehabilitation
      • Out of state facility – paid for by Maryland Medicaid.
    • Not be in another waiver program at the same time.
    • The cost of community-based services must not be more than institutional care.
    • Be able to live safely  in your home and community with these waiver services.
  • Financial Eligibility Rules:
    • Monthly household income may not exceed 300% of SSI benefits.
    • Countable assets may not be more than $2,000 or $2,500, depending on eligibility category.

What services does the BI Waiver provide?

You get all Medicaid covered services and benefits. You also may get waiver services that include:

  • Day habilitation
  • Individual support services
  • Medical day care
  • Residential habilitation
  • Supported employment
