Overview of the Proposed Amendment 


Following stakeholder engagement on the proposed waiver amendment and a mandatory 30-day public comment period, DDA submitted a waiver
amendment application to the Centers for Medicare & Medicaid Services (CMS) on July 1, 2026.

The Waiver Amendment Application (broken down into sections), and Public Comment and State Response Summary are below. We have

Purpose of the Amendment:  A detailed description of the proposed changes and the reasons we are asking for them.​

Appendix C - Participant Services: This appendix describes the home and community-based waiver services that are furnished through the waiver, including applicable limitations on such services. Each service is described in a separate document.

Appendix E - Participant-Direction of Services: Specifies the participant direction opportunities that are offered in the waiver and the supports that are available to participants who direct their services.


Appendix I - Financial Accountability: Describes the methods by which the State makes payments for waiver services, ensures the integrity of these payments, and complies with federal requirements concerning payment and federal financial participation.


Appendix J - Cost-Neutrality Demonstration: the State's demonstration that the waiver is cost-neutral.


​Public Comment  and State Response Summary

DDA received a total of 846 unique comments during the public comment period that was held from April 29, 2026 through May 28, 2026. Here is a summary  of those comments, and how DDA responded to the comments. Please note that during the public comment period, DDA received several recommendations for which further engagement with stakeholders is needed. These recommendations were not accepted for this amendment but may inform future amendments.

Key Updates

Self-Directed Services Model:

For participants in the Self-Directed Services model, implementation of the new Reasonable & Customary Wage Standards has been extended. Participants will have the option to freeze wages at the levels in effect on June 30, 2026, to support the extended implementation timeline. Allowable wages will remain at June 30, 2026 levels until CMS approves the waiver amendment. If participants wish to make changes to employee wages, please reach out directly to the Financial Management and Counseling Services (FMCS) vendor.

Community Provider-Managed Model:
For the Community Provider-Managed model, the implementation of the rate reduction has been extended. Provider rates will remain at the June 30, 2026 levels until CMS approves the waiver amendment.

​What Happens Next:
CMS has 90 days to review our waiver amendment application. Any changes would go into effect after CMS approval of our application. 

DDA will host regional listening sessions and technical assistance webinars to help providers, participants, and support teams understand upcoming changes, when they take effect, and what actions need to be taken and by when.
