Leave Information and Forms

Accident Leave
State merit employees are eligible to receive accident leave for compensable workplace injuries. Accident Leave is paid at two-thirds of your regular pay rate and is not subject to taxation.

Contractual employees are not eligible for Accident Leave but may receive coverage for medical expenses if their claim is deemed compensable by IWIF or the Workers' Compensation Commission.

Leave Information
Annual Leave
Annual leave is available for any purpose with prior approval from the employee’s supervisor. New employees must complete 6 months of State service before they are eligible to use annual leave.

  • Annual leave is accrued based on years of service (based on an 8-hour workday for full-time employees):
    • 10 days per year with less than 5 years of service
    • 15 days per year with 5 to less than 10 years of service
    • 20 days per year with 10 to less than 20 years of service
    • 25 days per year with 20 or more years of service
  • Employees may carry over up to 75 days (600 hours) of annual leave from one year to the next.
Family and Medical Leave Act (FMLA)
FMLA provides a 12-week unpaid leave entitlement that runs concurrently with your available leave balances. It protects your absence due to a qualifying medical reason or the need to care for a qualifying family member with a qualifying medical condition. FMLA-protected absences cannot be used against you in a performance evaluation. Once your available leave is exhausted, FMLA will continue to protect your absence in an unpaid status. FMLA can be utilized either intermittently or continuously and runs concurrently with all accrued leave, leave programs, and entitlements.

To qualify for FMLA, employees must meet the following criteria:

  • Have at least one year of State service,
  • Have worked 1,250 hours in the 12 months prior to the date of the request,
  • Have a qualifying medical reason.

Parental Leave

Parental Leave provides a 12-week paid leave entitlement that incorporates the use of your available annual leave, personal leave, and annual leave accruals. Once your leave is exhausted, the Parental Leave type will be applied to cover the remainder of the 12-week entitlement.

You may use available sick leave for up to six weeks immediately following the birth of your child. Once the sick leave is exhausted or the six-week period ends (whichever occurs first), the 12-week Parental Leave entitlement begins.

Proof of birth is required to process your request. This documentation must include your name, the baby’s name, and the date of birth. If eligible, FMLA will run concurrently with Parental Leave once proof of birth is received. No additional documentation is required for FMLA designation in this case.

Personal Leave
Personal leave is available for any purpose, provided the employee gives prior notification to their supervisor. Each employee is entitled to 6 days (not to exceed 48 hours) or leap years  7 days (not to exceed 56 hours) of personal leave at the beginning of the first full pay period of the calendar year.

Key details regarding personal leave:
  • For new employees, personal leave may be prorated based on the month employment begins.
  • Personal leave cannot be carried over from one calendar year to the next.
Parental Leave Request Form

Sick Leave
State merit employees accrue sick leave at a rate of 4.62 hours per pay period (15 days per year). Employees must notify their supervisor when using this leave. There is no limit to the number of sick leave days an employee may accrue or carry over into a new calendar year. ​​ 

Leave that can be used for the following reasons:
  • for illness or disability of the employee;
  • for death, illness, or disability of a member of the employee’s immediate family;
  • following the birth of the employee’s child;
  • when a child is placed for adoption;
  • or for a medical appointment of the employee or a member of the employee’s immediate family.
Sufficient documentation is required for absences of five or more consecutive days. To avoid a sick leave review for having six or more undocumented absences within 12 months, it is recommended to provide documentation for all absences.

Sick and Safe Leave
Sick and Safe Leave is an entitlement available to merit and contractual employees. It runs concurrently with your available leave balances, allowing you to take leave for qualifying reasons without documentation for up to two consecutive missed shifts.

This leave is not an additional leave type and cannot be used in an unpaid status. Employees may use up to 64 hours of Sick and Safe Leave per calendar year and may carry over a maximum of 40 unused hours to the following year.

Leave Bank Program
Employees interested in joining the Leave Bank must donate 8 hours of sick, annual, personal leave, or a combination of these.
New employees may join within their first 60 days of employment or during the annual open enrollment period, which coincides with the State’s health insurance open enrollment.
  • Current employees may join or renew their Leave Bank membership during the open enrollment period.
  • Employees joining the Leave Bank for the **first time** must wait **90 days** before they are eligible to use leave from the Bank.
  • Membership is valid for a **two-year period** and can be renewed by donating an additional eight hours of leave at the time of renewal.
